The employer also herein certifies that the wage it will pay exceeds the prevailing wage. The Department of Labor issued the PWD, Case #P10021145341638 based on the details provided on the Application for Prevailing Wage Determination Form ETA9141, which accurately reflects the details of the offered employment. The employment details listed on Form ETA9141 include the job title, job duties, job requirements, and job location, as well as the employers FEIN and the employer contact information, all of which are the key elements that are required to issue a proper prevailing wage. Upon final review, the employer identified that Form ETA9141, Section C Employer Information, Section 1 Legal Business Name, inadvertently lists the law firms name of Berry Appleman Leiden LLP in lieu of the employers name of SVB Financial Group. This is a nonmaterial typographical error that has no bearing on the actual prevailing wage amount because the location, the employers FEIN number and all other details regarding the offered employment are accurate. Listing SVB Financial Group in field C #1 would not have changed the issued PWD information. Furthermore, the Dept. of Labor had an opportunity to review the submitted ETA9141 and issued the prevailing wage, upon which the employer reasonably relied on the validity of the PWD. The employer hereby discloses this error in good faith and kindly requests that the Dept. of Labor, which issued the PWD, reconfirm its application when reviewing and certifying the accompanying Form ETA 9089.
